Understanding Your Responsibilities During an Insurance Claim

Last Updated on September 28, 2026 by Darren Carter.

In this article, we will explore what these responsibilities entail and how you can ensure that your claim is handled properly.

Take Charge: Your Role in the Insurance Claim Process

After property damage occurs, the actions you take can affect both the condition of the property and the evidence available during an insurance claim.

Policyholders will usually need to report the loss, provide reasonable information requested by the insurer and take sensible steps to prevent avoidable additional damage. The exact requirements will depend on the policy wording and circumstances.

The Power of Proactive Measures

Where it is safe and practical, temporary action may be needed to prevent damage from becoming worse. This could include arranging an emergency repair to stop a leak or temporarily protecting an exposed part of a building.

However, personal safety comes first. Do not enter an unsafe building, work at height or attempt electrical, structural or other hazardous repairs simply to protect an insurance claim.

This guide explains some of the practical responsibilities that may arise and how to approach them reasonably while a claim progresses.

1. The Duty to Mitigate Losses

Taking Reasonable Steps to Prevent Further Damage

After insured damage occurs, a policyholder may need to take reasonable steps to prevent avoidable additional loss. What is reasonable will depend on the circumstances, the type of damage and the policy terms.

For example, if a roof is damaged and rain could enter the property, temporary protection may be appropriate where it can be arranged safely. Similarly, an active water leak may need urgent attention to reduce further damage.

Where practical, contact the insurer or its emergency helpline for guidance. Keep photographs and receipts for necessary emergency work, as these may be relevant to the claim.

2. Acting Reasonably During the Process

While it's essential to act quickly, it's equally important to ensure that your actions are reasonable.

Keep Emergency Action Reasonable and Necessary

Emergency action should be proportionate to the problem. The purpose is usually to make the property safe or prevent avoidable additional damage rather than to carry out unnecessary or unrelated improvements.

Where you incur emergency costs, keep photographs, invoices and receipts and record why the work was necessary. If significant expenditure is being considered and there is time to contact the insurer first, ask for guidance before committing to the work.

Whether an emergency cost is covered will depend on the policy wording and circumstances. Reasonable action to protect the property does not, by itself, guarantee that the underlying insurance claim will be accepted.

3. Timing Matters

Report the Damage and Act Without Unnecessary Delay

Once damage is discovered, check the policy for any notification requirements and contact the insurer without unnecessary delay.

If urgent action is needed to prevent further damage before you can speak to the insurer, take reasonable protective steps where it is safe to do so. Keep a record of what happened, the action taken and any associated costs.

A delay does not automatically mean that a claim will fail. Whether it affects the claim will depend on the policy wording, the reason for the delay and whether the insurer’s position has been materially affected.

Balance Prompt Action With Reasonable Decisions

Managing the immediate aftermath of property damage usually involves balancing several priorities: personal safety, preventing avoidable additional damage, notifying the insurer and preserving useful evidence.

Keep records of significant decisions, photographs and emergency expenditure where possible. However, do not assume that taking a particular action guarantees the claim outcome. Cover will depend on the policy wording, cause of damage, evidence and circumstances.

Policyholders also have the right to expect proper claims handling. FCA rules require insurers to handle claims promptly and fairly, provide reasonable guidance to help policyholders make a claim and provide appropriate information about progress.

Need Assistance With an Ongoing Insurance Claim?

How Independent Loss Adjusters Can Support an Ongoing Claim

If a property insurance claim becomes difficult to manage, Independent Loss Adjusters may be able to provide policyholder-side support.

Depending on the claim, our work can include:

  • Damage and evidence review: Reviewing photographs, reports, invoices and other information relevant to the loss.
  • Policy and claim review: Considering relevant policy wording and the insurer’s stated position.
  • Emergency-action review: Helping organise evidence of temporary repairs or other reasonable steps taken to prevent further damage.
  • Claim organisation: Helping organise information and documentation as the claim progresses.
  • Insurer communication: Communicating with the insurer and its representatives where we are appointed to do so.
  • Settlement review: Reviewing proposed repair scopes or settlements against the policy wording, available evidence and supported costs.

ILA cannot guarantee that particular action taken after a loss will be accepted by an insurer, that a claim will be paid or that a settlement will increase. The outcome will depend on the policy wording, evidence and circumstances.
