Section 75 Claims Assistance
Everything You Need To Know & How Independent Loss Adjusters Can Help.
When you make a purchase with your credit card, you may not realise that you have powerful consumer protection under Section 75 of the Consumer Credit Act 1974. Section 75 can make a credit provider jointly liable with the supplier where the supplier has breached its contract or made a qualifying misrepresentation, provided the legal requirements are met. Whether you’ve been scammed, received faulty goods, or a business has gone bust, Section 75 claims can help you recover your money.
At Independent Loss Adjusters (ILA), we understand that navigating financial claims can be complex. ILA can review the information provided and help you understand whether Section 75 may apply and what evidence could support your position.
A Section 75 claim may allow a consumer to pursue a credit provider where a supplier has breached its contract or made a misrepresentation. It can apply to qualifying credit-card purchases, point-of-sale loans and certain other credit arrangements.
Section 75 can apply where the cash price of an individual item, service or qualifying set is more than £100 and no more than £30,000.
Where Section 75 applies, the consumer may pursue the credit provider as well as, or instead of, the supplier. The provider will consider whether there has been a relevant breach of contract or misrepresentation and what remedy may be appropriate.
Filing a Section 75 claim can be straightforward if you follow the correct steps. Here’s a step-by-step guide to maximising your chances of success:
1. Contact the Retailer First
It is often sensible to ask the supplier to resolve the problem first, unless it has ceased trading, cannot be contacted or there is another reason this would be impractical. However, pursuing the supplier first is not a legal requirement before making a qualifying Section 75 claim against the credit provider. Explain your complaint and request a refund or replacement.
2. Gather Your Evidence
To strengthen your claim, collect as much supporting evidence as possible, including:
Before sending bank statements, contracts or other personal documents, read how ILA handles personal information.
3. Contact Your Credit Card Provider
If the retailer refuses to help, write to your credit card company explaining your claim. Include all supporting evidence and clearly state the amount you are claiming.
4. Escalate Your Claim if Needed
If the credit provider rejects the claim or handles it poorly, make a formal complaint to the provider. You can normally refer the complaint to the Financial Ombudsman Service after receiving its final response or if it has not provided one within eight weeks.
Although Section 75 offers strong consumer protection, there are some important exclusions:
Purchases outside this range are not covered under Section 75, but you may still be eligible for a chargeback claim.
Using an intermediary or payment platform does not automatically remove Section 75 protection. The outcome depends on whether the required debtor-creditor-supplier relationship remains in place and how the payment was processed. PayPal and similar payment routes can produce different outcomes depending on the particular arrangement.
Qualifying third-party Buy Now Pay Later agreements entered into on or after 15 July 2026 may also receive Section 75 protection.
Section 75 applies only to credit card transactions, not debit card payments. However, a chargeback claim may still be possible through your bank.
Business-purpose purchases can be more complex. Whether Section 75 applies will depend on matters including the borrower, the type and terms of the credit agreement, the contractual parties and the required debtor-creditor-supplier relationship. Specific advice may be needed rather than assuming that every business purchase is either covered or excluded.
Transactions made via bank transfer or cash do not fall under Section 75 protection, making them riskier payment methods.
